JAISWAL FAMILY COURT APPEAL No.298 of 2013 ORAL ORDER: (Per Suresh Kumar Kait,J) Learned counsel appearing on behalf of the appellant submits that the matter has been settled between the appellant and the respondent vide memorandum of understanding dated 16.12.2017, which is on record. As per the said memorandum of understanding, respondent/husband has agreed to pay an amount of Rs.15,00,000/- (Rupees Fifteen Lakhs only) to the appellant/wife towards permanent alimony and maintenance including all her claims in view of the settlement in all the cases including Crl.M.P.No.281 of 2016 in M.C.No.262 of 2008 and F.C.A.No.298 of 2013 on the file of this Court.

The appellant and the respondent are personally present in the Court and are identified by their respective counsel. This Court interacted with the appellant, who states that she has received the total amount of Rs.15,00,000/- by way of various demand drafts and she has no objection if the present appeal is allowed to be withdrawn. Learned counsel appearing on behalf of the appellant submits that, in view of the memorandum of compromise dated 16.12.2017, since the matter has been settled between the appellant and the respondent, this appeal may be allowed to be withdrawn.

In view of the settlement arrived at between the parties, the appeal stands dismissed as withdrawn.

As a sequel, miscellaneous petitions if any pending in the appeal stand closed.
