THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.15751 OF 2016 O R D E R :

The case of the petitioner is that she filed a representation dated 22.02.2016 for mutation of her name in the revenue records in respect of the land admeasuring Ac.0-31 guntas in Sy.No.200/3 situated at Mulkal Village, Mancherial Mandal, Adilabad District, which was gifted to her by one Potharajula Ramchander by way of registered gift deed bearing No.3963 of 2015 dated 09.04.2015. As no orders are passed, the present writ petition is filed.

Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue produced written instructions dated 06.06.2016 issued by the Tahsildar, Mancherial wherein it is stated that the so called gift deed executed in favour of the petitioner is in contravention of Andhra Pradesh Assigned Lands (POT) Act, 1977, as such her name cannot be mutated in the revenue records. He also submits that the petitioner has not made the application in proper format.

In view of the above, without expressing any opinion on merits, it is open for the petitioner to make an application in proper format. On such application being made by the petitioner, the 4th respondent is directed to dispose of the same in accordance with law after verifying the genuineness of the gift deed executed in favour of the petitioner and after considering

whether the same is in contravention of the Andhra Pradesh Assigned Lands (POT) Act, 1977. If the petitioner is aggrieved by the order passed by the 4th respondent, she is at liberty to challenge the same.

Accordingly, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
