THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.21912 OF 2014 ORDER:
This writ petition is filed seeking to issue a writ of mandamus to declare the inaction of the respondents 2 and 3 in allotting TFT Toddy licence to the petitioner for the newly formed Grampanchayat at Achampet Mandal, Mahaboobnagar District, inspite of letter, dated 27.12.2013, sent by the 2nd respondent to the 1st respondent. The petitioner is the permanent resident of Bolgattu Palli village Achampeta Mandal, Mahaboobangar District. He made an application to the 2nd respondent for allotment of TFT licence for doing toddy business in the village. While his application is pending with the 2nd respondent, the 5th respondent, who is not a permanent resident of the said village also applied for issuance of TFT licence by submitting false and fake documents.
Therefore, the petitioner along with the village elders made an application to the 4th respondent to cancel the fake documents issued in favour of the 5th respondent. The authorities are allowing the 5th respondent to do toddy business in the village illegally without granting any licence. The grievance of the petitioner is that the authorities concerned are not considering his application for grant of licence, but they are allowing the 5th respondent to do business without any licence. Hence, this writ petition.
When the matter is taken up for hearing, learned Government Pleader for Prohibition & Excise submitted that the application of the petitioner is under process and the respondents will take appropriate action on the application of the petitioner for grant of TFT lcecne, as expeditiously as possible.
Recording the said submission of the learned Government Pleader, the writ petition is disposed of and the 2nd respondent is directed to consider the application of the petitioner for grant of TFT licence in his favour and pass appropriate orders in accordance with law as expeditiously as possible, preferably, within a period of eight (8) weeks from the date of receipt of a copy of this order. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
