THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.9453, 9458 and 9459 OF 2015 COMMON ORDER :

As the issue involved in all these writ petitions is one and the same, they are being disposed of by way of this Common Order. All these writ petitions are filed assailing the impugned notices dated 25.03.2015 issued under Sections 452 & 461 of the Hyderabad Municipal Corporation Act, 1955 ( for brevity 'the Act') by the respondent Corporation, wherein it is called upon the petitioners to show-cause as to why such portion of the structure mentioned in the show-cause notice should not be removed, so as to bring it in conformity with the approved plan and mater plan zoning regulations. The petitioners have filed explanations dated 30.03.2015 to the show-cause notices issued by the respondent Corporation.

However, without considering the explanations filed by the petitioners, the respondent Corporation is trying to demolish the structures of the petitioners. Aggrieved by the same, the present writ petitions have been filed. Heard learned counsel for the petitioners as well as Sri S.Laxminarayana Reddy, learned Standing Counsel for the respondent Corporation. Sri S.Laxminarayana Reddy, learned Standing Counsel for the respondent Corporation submits that only after considering the explanations of the petitioners, appropriate action will be initiated. In view of the submission of the learned Standing Counsel for the respondent Corporation, since the petitioners have filed explanations to the impugned notices, it is for the respondent Corporation is to consider the same and pass appropriate orders, in accordance with law.

Till then, Status quo obtaining as on today shall be maintained.

With the above direction, these writ petitions are disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in these writ petitions, shall stand closed.
