THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.5532 OF 2016 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

Complaining inaction on the part of the Tahsildar, Munagala Mandal, Nalgonda District, the 3rd respondent, in not taking the petitioner's application dated 08.10.2015 seeking correction of entry in the revenue records by incorporating their names, this Writ Petition is filed.

Learned Government Pleader for Revenue has received instructions from the 3rd respondent, which inter alia state that the application dated 09.11.2015 filed by the 2nd petitioner before the Revenue Divisional Officer, Suryapet, Nalgonda District, the 2nd respondent, has been forwarded to the 3rd respondent with a direction to conduct enquiry. It is stated that notices under Form - VIII of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 have been issued to respondents 4 and 5, which have also been acknowledged on 21.12.2015. It is also stated that the said respondents filed their objections and enquiry was proposed to be held on 22.02.2016 at 3:00 P.M. However, since the 3rd respondent was affected by Dengue fever and was on leave, the enquiry was not conducted.

Therefore, it is apparent from the above that the enquiry was already initiated on the complaint of the petitioners and the same is proposed to be held shortly.

Hence, in my view, it is appropriate to direct the 3rd respondent to fix a fresh early date for the proposed enquiry and after notice to the petitioners and respondents 4 and 5, conduct necessary enquiry and pass appropriate orders in accordance with law, expeditiously.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
