ORDER

This Writ Petition is filed seeking the following relief: "to issue an order, direction or writ particularly one in the nature of writ of mandamus or appropriate writ (i) declaring the action of the respondent in not protecting the basic pay of petitioners in the post of Security Guard is illegal and arbitrary (ii) declare that the petitioners are entitled for the protection in the scale of pay of Rs.5814-145-8424 consequent on their conversion from the post of Coal Filler to Security Guard on par with similarly situated employees (iii) and pass such other order or orders as the Hon"ble Court deems fit and proper in the circumstances of the case."

Heard Smt K.Udaya Sri, learned counsel appearing for the petitioners, and learned Standing Counsel appearing for the respondents.

Initially, the petitioners were appointed as Coal Fillers in the year 2006 and after rendering considerable length of service, their services were converted as Security Guards in the year 2009. It is the grievance of the petitioners that though the respondents have not protected their pay in the earlier category of Coal Filler, protected the pay scale of the similarly situated employees. Hence, the petitioners have

submitted a representation dated 15.03.2012. But, so far, no orders have been passed thereon.

Learned counsel appearing for the petitioners submits that the respondents be directed to consider the representation of the petitioners dated 15.3.2012 and pass appropriate orders in accordance with law.

Learned Standing Counsel appearing for the respondents submits that the respondents would consider and pass appropriate orders on the representation of the petitioners dated 15.03.2012.

Having considered the rival submissions made by the learned counsel on either side, this Writ Petition is disposed of directing the respondents to consider the representation of the petitioners dated 15.03.2012 and pass appropriate orders thereon, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous petitions, pending, if any, shall stand closed.
