THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.741 OF 2015 ORDER:
This Criminal Revision Case is filed by the petitioner under Section 397 (1) Cr.P.C., challenging the order, dated 18.02.2015 passed in I.A.No.107 of 2015 in MC No.11 of 2015 by the Judge, Family Court, Nellore.
The case of the prosecution, in brief, is that the petitioner is the husband of the 2nd respondent. Their marriage was performed on 14.12.2005 and they were blessed with a male child. Due to differences between them, the petitioner obtained divorce in FC OP No.1135 of 2010 on 06.11.2010. Thereafter, the 2nd respondent filed MC No.11 of 2015 before the Family Court, Hyderabad, seeking maintenance from the petitioner at Rs.50,000/- for herself and Rs.25,000/- for their son.
The Family Court granted interim maintenance at Rs.15,000/- to the 2nd respondent and Rs.10,000/- to the 3rd respondent in I.A. No.107 of 2015. Alleging that the Family Court has passed an ex parte order granting interim maintenance to the respondents 2 and 3, the present revision case is filed by the petitioner.
Heard and perused the material available on record. During the course of arguments, learned counsel for the petitioner informed that the petitioner has invoked the provisions under Section 127 Cr.P.C., and also filed an application to set aside the ex parte order, passed by the Court below and prayed to direct the Court below to dispose of the said applications expeditiously. In view of the limited prayer, the Criminal Revision Case is disposed of directing the Court below to dispose of the application filed
under Section 127 Cr.P.C., and also the application to set aside the ex parte order, by the petitioner as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order.
