HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 24105 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for Shop No. 46 of Chemudubadu village, Kollipara Mandal, Guntur District. While so on 18.4.2015, the police of Kollipra intercepted one goods vehicle carrying PDS rice. Based on the confession made by the good vehicle driver, the petitioner was shown as Accused No. 7 in Crime No. 41 of 2015. In respect of the same incident, a show cause notice was issued on 8.5.2015 while suspending the authorization of the petitioner on the same day. The petitioner submitted his explanation on 18.5.2015. When the enquiry is not completed, he challenged the order dated 8.5.2015 in the present Writ Petition.

The second respondent already issued a show cause notice and the petitioner submitted his explanation. In view of the pendency of the enquiry before the second respondent, this Court is not inclined to interfere with the enquiry process at this stage. In the circumstances, the second respondent is directed to complete the enquiry by giving due opportunity to the petitioner and pass final order within thirty days from the date of receipt of a copy of this order. Subject to the above, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
