THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.23371 of 2015 ORDER :
The petitioner is a resident of house bearing No.25-10-20, Narsimharaopet, Eluru, West Godavari District. According to the petitioner a Peepal tree was planted long ago in the adjoining place on the southern side of Ramalayam and this tree has grown and its roots are grown underground and its grown roots are affecting the structures of the petitioner and adjoining owners. There is apparent cracks in the wall as well as the floor inside the compound. Apprehending threat to the very structure, representations were submitted to the Municipal Corporation on several occasions. But so far no action is taken. The latest representation is submitted to the Mayor on 16.01.2015 and the recent representation i.e., 15.04.2015 is submitted to the Commissioner, Municipal Corporation.
2. Since ventilating the grievance, representations are submitted to the Mayor on 16.01.2015 and to the Commissioner on 15.04.2015, without expressing any opinion on merits, the Writ Petition is disposed of directing the respondent-Municipal Corporation, to consider the representation of the petitioner, look into the grievance agitated by the petitioner and take corrective steps, if required, or intimate the petitioner the proper course of action to be adopted. A decision to this effect on the representation of the petitioner shall be taken and communicated to the petitioner within a period of four (4) weeks from the date of receipt of copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
