G. Sivanagendra Reddy, S/O Vannuru Reddy, v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.42999 of 2015 04.01.2016 Between:
G.Sivanagendra Reddy .. Petitioner and The State of Andhra Pradesh, represented by its Principal Secretary, Municipal Administration and Urban Development Department, Hyderabad and others .. Respondents Counsel for the petitioner: Mr.Challa Srinivasa Reddy Counsel for respondent Nos.1 and 2: Government Pleader for Municipal Administration and Urban Development (AP) Counsel for respondent Nos.3: -- Counsel for respondent Nos.4 to 6: -- The Court made the following:
ORDER:
The petitioner, who has a serious grievance with respondent Nos.
4 to 6 for allegedly encroaching a part of his land, has approached this Court for the second time. Earlier, he has filed W.P.No.41706 of 2015 with the grievance that respondent No.3 has not been considering his application for mutation of his name in the property register in place of respondent Nos.4 and 5. In the present writ petition, the grievance of the petitioner is that the said respondents have mislead respondent No.3 and obtained building permission in respect of a substantial part of his land encroached by them. At the hearing, Mr.Ancha Pandu Ranga Rao, learned standing counsel for the Municipal Corporations (AP) appearing for respondent No.3, has submitted that this Court has disposed of W.P.No.41706 of 2015 on 28.12.2015 directing respondent No.
3 to consider the petitioner's application for mutation by holding an enquiry and take an appropriate decision thereon. He has further submitted that as the subject matter of the dispute is common though the nature of the grievance of the petitioner in both the writ petitions is distinct, respondent No.3 will hold a comprehensive enquiry, take an appropriate decision both in respect of mutation as well as allegation made by the petitioner that respondent Nos.4 and 5 have obtained building permission by misrepresentation in respect of a substantial part of his land.
In the light of the above submissions of the learned standing counsel, which are placed on record, the Writ Petition is disposed of. As a sequel to disposal of the Writ Petition, W.P.M.P.No.55448 of 2015 filed by the petitioner for interim relief shall stand disposed of as
infructuous.
