HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No.3830 of 2016 ORDER:

The action of respondent - officials, in calling the petitioner to the police station and pressurising to settle the civil disputes, at the instance of respondent No.4, is questioned in the Writ Petition as being illegal and arbitrary.

The grievance of the petitioner is that respondent No.3 called the petitioner to the police station on 28.01.2016 and had threatened and terrorised to register sale deed in favour of respondent No.4.

In his counter affidavit, respondent No.3-SHO, Chilakaluripet Town P.S., denied the allegation of calling the petitioner to the police station and threatening him to register the sale deed. It is further stated that the police has enquired into the matter on the complaint of respondent No.4 and never harassed or threatened the petitioner to settle the civil disputes with respondent No.4. In view of the interim order passed by this Court in WPMP.No.4910 of 2016 dated 09.02.2016 directing the respondent police not to interfere in any civil dispute or bring any pressure to bear upon the petitioner or his family members to settle any such dispute, no further orders are required and the said order is hereby made absolute.

It is unfortunate to note that, time and again writ petitions are being filed by the petitioners making allegations against the police officials that they are calling to police station for settlement of matters in police station. Police, however, in their counters, deny the allegations as false. Petitioners are approaching this Court seeking a direction to police not to call them to the police station. In view of the law laid down by the Supreme Court in Lalita Kumari v. Government of U.P.1 and the decision rendered by this Court in Darapaneni Krishna Murthy v. Superintendent of Police2, police are directed not to interfere in civil matters.

With the above observation, the Writ Petition stands disposed of.

Miscellaneous petitions, if any pending, shall stand closed.
