THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.2742 of 2016 ORDER :

Petitioners in this Writ Petition assail the action of the respondents in seizing their vehicles i.e., Splendor+(Drunk spoke) BSII bearing No.AP 24 AW 3715 and Auto Three Wheeled Goods vehicle bearing No. AP 36 TA 6225 and not releasing the same to the petitioners.

2. The learned Government Pleader for Civil Supplies appearing for respondents states that if the petitioners are willing to give a bank guarantee for the value of the seized vehicles as assessed by the 2nd respondent and keep the said bank guarantee alive during the pendency of proceedings against them under Section 6A of the Act, the respondents have no objection for release of vehicles to the petitioners.

3. In view of the said submission, the Writ Petition is disposed of directing the respondents to release the vehicles i.e., Splendor+(Drunk spoke) BSII bearing No.AP 24 AW 3715 and Auto Three Wheeled Goods vehicle bearing No. AP 36 TA 6225 to the petitioners subject to the petitioners producing documents in proof of ownership, furnishing a bank guarantee for the value of the vehicles as assessed by the 2nd respondent and subject to the petitioners keeping the said bank guarantee alive and not alienating or encumbering the said vehicles, during the pendency of proceedings under Section 6A of the Act. There shall be no order as to costs.

4. Consequently, miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
