HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 28764 of 2015 ORDER:

This Writ Petition is filed seeking a direction to the fifth respondent to pay subsistence allowance to the petitioner from the month of May, 2013.

The petitioner was working as Chief Executive Officer in the fifth respondent-Society. While so, he was suspended by proceedings dated 24.10.2013 for a period of six months. When no subsistence allowance is paid, the petitioner filed the present Writ Petition.

The fifth respondent filed a counter affidavit stating that

huge amounts of the Society were misappropriated by the petitioner.

It is further stated that the petitioner is not cooperating with the enquiry and receiving the charge memo. However, it is stated that the fifth respondent-society is willing to pay subsistence allowance to the petitioner. In the circumstances, the Writ Petition is disposed of directing the fifth respondent to issue charge memo to the last address of the petitioner and pay him subsistence allowance from the date of suspension within a period of one month from the date of receipt of a copy this order and continue to pay till completion of enquiry. It is needless to observe that the petitioner shall cooperate with the enquiry and the enquiry initiated against the petitioner shall be completed within a period of six months from the date of receipt of a copy of this order.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
