THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25230 of 2016 ORDER:

The petitioner was appointed as a Junior Assistant in respondent No.3 temple on compassionate grounds due to the death of her father, who was working as Archaka in respondent No.3 temple. She was promoted as Senior Assistant with effect from 15.02.2012. She applied for maternity leave from 10.09.2015 to 07.03.2016 and she sought extension of that leave and both the leaves were granted upto 07.06.2016. When she was in leave, respondent No.2 issued the impugned proceedings transferring her from respondent No.3 temple to Sri Veera Venkata Satyanarayana Swamy Temple, Annavaram, East Godavari District. Challenging the said transfer order on the ground that she is having a girl child of eight months old and her husband is working as N.M.R. in respondent No.3 temple, she filed the present writ petition.

Learned Government Pleader on the basis of written instructions submits that a decision was taken to transfer the longstanding employees by the Hon'ble Minister for Endowments in the meeting held on 17.06.2016 in order to improve the standards of service in the temple and in the public interest, certain transfers were effected and the petitioner was also transferred in that process. Since the husband of petitioner is not a regular employee, the plea of posting the husband and wife in the same place does not arise.

It is clear from the facts of the case that the petitioner has been working since 2006 in respondent No.3 temple. Respondent No.2 passed the impugned order of transfer in exercise of the

routine administrative powers. The petitioner joined in the new station on 29.06.2016. In view of the same, this Court cannot interfere with the impugned order. However, this order will not prevent the respondents from considering the petitioner's representation on humanitarian grounds.

With the above observations, this Writ Petition is dismissed. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
