Guniguntla Narasimha Rao v. The State Of Andhra Pradesh, Rep. By Its Principal

2016-12-29S.V.Bhatt2 pages

THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.46220 of 2016 ORDER:

Petitioner prays for the following relief:

"...... To issue an appropriate order or direction more particularly a writ of mandamus declaring the action of respondent Nos.2 and 3 in failing to appoint the petitioner as dealer for F.P. Shop No.5, situated at Nandigama Village and Mandal, Krishna District in the place of the petitioner sister by duly declaring and pass such order....."

Learned counsel for petitioner submits that the petitioner is satisfied if a direction is issued to respondent Nos.2 and 3 to consider the representation, dated 15.05.2015, and pass orders in accordance with the applicable Government Policy. As the alternative prayer is against inaction, I am satisfied, the writ petition can be disposed of by this order: "Petitioner is given liberty to resubmit copy of representation along with the instant order to respondent Nos.2 and 3 within two weeks from today. Respondent Nos.2 and 3 are directed to examine the representation and pass orders within four weeks thereafter in accordance with the applicable Government Policy and instructions issued from time to time."

Writ petition is accordingly disposed of.

As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs. ________________ S. V. BHATT, J Dt:29.12.2016 kdl
