HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.38627 OF 2018 ORDER:

Heard the learned counsel for the petitioner, the learned Government Pleader for the 1st respondent and Sri S.Ganesh, the learned Standing Counsel for respondents 2 and 3. Since this Court is not going into the merits of the case, it may not be necessary to issue notice to the unofficial respondents.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents 2 and 3 in proposing to transfer the registration of the vessel/ boat No. 456 G (ML Sri Punnami) in favour of third parties, ignoring the objections of the petitioners, as illegal, improper and incorrect. 3.

As seen from the record, disputes are pending between the petitioners and unofficial respondents with regard to the transfer of registration of the vessel/ boat, and also the amounts to be paid, which led to filing of O.S.No. 171 of 2018 on the file of the District Judge, Family Court, East Godavari District, Rajahmahendravaram. It is stated that respondents 4 and 5 are the legal heirs of one Gondesi Gopala Krishna and they are making efforts to transfer the registration of the vessel in favour of third parties, and that the official respondents are likely to consider the same without taking into consideration the objections of the petitioners.

Having regard to the facts and circumstances of the case, if the registration of the vessel is not yet transferred in favour of third parties

as on today, and if any objections are already filed by the petitioners herein, the 2nd and 3rd respondents shall deal with the same, after hearing the petitioners as well as the respondents 4 and 5, and pass orders in accordance with law.

Accordingly, the present writ petition is disposed of at the admission stage. No order as to costs. As a sequel to disposal of the writ petition, miscellaneous petitions pending, if any, shall stand closed. ____________________ C. PRAVEEN KUMAR, J 26.10.2018 DMG
