HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.10730 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 3.

This Writ Petition is filed seeking to declare the inaction of the 2nd respondent in releasing the seized stock on the application of the petitioner dated 11.02.2015, as illegal and arbitrary.

Petitioner is doing business in food grains and fertilizers under the name and style of Sri Kanaka Nagalakshmi Traders, Visakhapatnam. The officials of the Vigilance Department inspected the godown of the petitioner, seized 399 bags of rice on the ground that he is not having licence and registered a case under Section 6-A of the Essential Commodities Act, 1955. Learned counsel appearing for the petitioner submits that the petitioner has already filed an application before the 2nd respondent, but so far no orders have been passed thereon.

Under these circumstances, the Writ Petition is disposed of directing the 2nd respondent - Joint Collector, Visakhapatnam, to dispose of the application submitted by the petitioner whereunder he sought for

release of the seized stock, within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
