THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 15065 of 2015 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for respondents.

2. It is the case of the petitioner that he was selected as Field Assistant of Valicherla Village, Hanumanthunipadu mandal, Prakasam district and he was appointed by order dated 08.11.2006. While so, a Show Cause Notice was issued to him on 28.09.2010 asking him to submit his explanation and he submitted his explanation. The 3rd respondent, who issued the Show Cause Notice, passed an order on 16.12.2014 removing him from the post of Field Assistant. It is his case that challenging the said order, he submitted an appeal on 16.03.2015 before the 2nd respondent, but the 2nd respondent did not pass any order thereon and the appeal before the 2nd respondent was pending. The respondents 3 and 5 are taking steps to fill up the post as per the Notification issued in Sakshi Daily Newspaper on 14.05.2015.

3. In the circumstances, the writ petition is disposed of directing the 2nd respondent to dispose of the appeal preferred by the petitioner against the order passed by the 3rd respondent, dated 16.12.2014, within a period of fifteen (15) days from the date of receipt of a copy of this order and any appointment of third party, if any, would be subject to the result of the order to be passed in the appeal. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
