THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.13328 of 2016 ORDER:

The prayer of the petitioner Sangam in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in rejecting the representation dt.7-4-2016 submitted by the petitioner requesting permission of the 2nd respondent to perform puja of Hanuman idol at Sy.No.256, Ibrahimbagh Village, Golconda Mandal, Hyderabad on Hanuman Jayanthi i.e. on 22-04-2016 vide proceedings Lr.Rc.No.S1/364/2016 dt.18-04-2016 as arbitrary, illegal and unjustified and consequently direct the 2nd respondent to accord permission to the petitioner Society to perform puja of the Hanuman idol situated at Sy.No.256, Ibrahimbagh Village, Golconda Mandal, Hyderabad on Hanuman Jayanthi i.e.

22-04-2016 by setting aside the proceedings dt.18-04-2016 of the 2nd respondent in the interest of justice and be pleased to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case." Perusal of the impugned proceedings dated 18.04.2016 reflects that the petitioner Sangam is being denied permission to perform puja only on the ground that the boulder on which the Hanuman figure is engrafted falls within the premises of Premamati Mosque which is a protected monument. However, it is not in dispute that a similar puja was permitted to be performed last year. A copy of the Memo dated 31.03.2015 issued by the Government of Telangana permitting the puja between 6.00 a.m. and 6.00 p.m. on Hanuman Jayanthi day is placed on record.

That being so, there is no reason as to why the respondent authorities should take a different stand this year. It is for the police authorities to make necessary arrangements to maintain peace and

law & order.

The writ petition is therefore disposed of in terms of the earlier Memo dated 31.03.2015. The respondent authorities shall accordingly permit the petitioner Sangam to perform Sri Hanuman Jayanthi puja on 22.04.2016 between 6.00 a.m. and 6.00 p.m. at Sy.No.256, Ibrahimbagh Village, Golconda Mandal, Hyderabad. However, no constructions shall be allowed to be made by the petitioner Sangam. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
