HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.9507 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies for the State of Andhra Pradesh.
2. This writ petition is filed seeking writ of Mandamus declaring the proceedings dated 26.02.2015 of the 3rd respondent in suspending the petitioner's authorisation of Fair Price Shop No.9 of Halvi Village, Kowthalam Mandal, Kurnool District, without any reasoned order, as illegal and arbitrary and for a consequential direction to the 3rd respondent to permit the petitioner to continue the petitioner as fair price shop dealer.
3. On receiving complaints against the petitioner, the revenue authorities inspected the fair price shop of the petitioner and found certain irregularities in distribution of the essential commodities and a show cause notice was issued to him. Thereafter, the petitioner submitted an explanation and according to the petitioner, without considering the same, the authorisation of the fair price shop of the petitioner was suspended. Against the said suspension, the petitioner preferred an appeal before the Joint Collector. Learned counsel appearing for the petitioner submits that the explanation submitted by the petitioner has not at all been taken into consideration while passing the impugned order.

Having regard to the afore mentioned facts, the 2nd respondent-Revenue Divisional Officer, Adoni, Kurnool District, is directed to complete the enquiry against the petitioner within a period of eight (8) weeks from the date of receipt of a copy of this order, notwithstanding pendency of the appeal before the Joint Collector and pass final orders by considering the explanation submitted by the petitioner and also affording an opportunity of personal hearing to the petitioner.
