THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.19375 OF 2014 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of the respondents in not allotting and not releasing the essential commodities to the petitioners' Fair Price Shops situated at Pulakunta Village and Kaggalu Village of Hindupur Mandal, Anantapur District without any valid reasons and trying to terminate their fair price shop dealerships without issuing any notice as illegal and arbitrary and consequently, to direct the respondents to continue the petitioners as Fair Price Shop Dealers of the said shops and allot the essential commodities. 2.

None appears for the petitioners and there is no representation on their behalf.

On 11.7.2014, this Court, while admitting the writ petition, passed an interim order in W.P.M.P.No.24260 of 2014 as follows: "The case of the petitioners is that they were appointed as fair price shop dealers on temporary basis for a period of six months or till the vacancy is filled up by the respondents on permanent basis, which ever is earlier. The grievance of the petitioners is that they are appointed in the year 2010 and continuing as such till today.

In view of the above, there shall be a direction to the respondents to supply stocks to the petitioners' fair price shops, till the regular appointments are made. However, this order will not preclude the competent authority from taking action against the petitioners, in case if they commit any violations."

Considering all the facts and circumstances of the case, this Court is of the view that the said interim order can be made absolute and the same is, accordingly, made absolute and the Writ Petition is disposed of. There shall be no order as to costs. 4.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
