HON'BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION No.5189 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents.

This writ petition is filed seeking to declare the inaction of the 2nd respondent in considering and disposing of stay petition filed along with revision on 02.02.2015 against the order of the 3rd respondent dated 13.01.2015 confirming the order of the 4th respondent dated 12.06.2014, as arbitrary and illegal. 3 . The petitioner is the Fair Price Shop Dealer of Shop No.31 of Interu Village, Kruthivennu Mandal, Krishna District. Alleging certain irregularities in distributing the essential commodities against the petitioner, the 4th respondent passed an order on 12.06.2014 by cancelling the authorisation of the petitioner. Against the said order, the petitioner filed an appeal before the 3rd respondent and as no stay was granted pending appeal, he filed WP No.19067 of 2014. This Court, by order dated 09.07.

2014, directed the 2nd respondent therein to consider and dispose of the appeal within a period of six weeks. Thereafter, the 3rd respondent passed an order on 13.01.2015 dismissing the appeal of the petitioner. Aggrieved by the said dismissal, the petitioner filed a revision before the 2nd respondent along with stay petition. The grievance of the petitioner is that the 2nd respondent has not granted any stay nor disposed of the revision petition.

4. Under the aforesaid circumstances, the writ petition is disposed of directing the 2nd respondent to dispose of the revision petition as well as the stay petition, within a period of eight (8) weeks from the date of receipt of a copy of this order. The

miscellaneous petitions, if any, pending in this writ petition shall stand closed. No order as to costs.
