Sri Kasukurti Nageswarao, v. Sri Kasukurti Surya Chandrarao
HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO C.R.P.No.4239 of 2016 ORDER:
Heard the learned counsel for the petitioner and the learned counsel for the respondents.
2.
Petitioner has filed this Revision Petition challenging the order dt.23-06-2016 in I.A.No.221 of 2016 in C.M.A.No.2 of 2016 of the Senior Civil Judge, Tadepalligudem.
3.
Petitioner was the plaintiff in the trial Court and he had filed O.S.No.257 of 2014 on the file of II Additional Junior Civil Judge, Tadepalligudem seeking permanent injunction and also I.A.No.1857 of 2014 for grant of relief of temporary mandatory injunction. The trial Court had dismissed the said application and challenging the same, the petitioner had filed C.M.A.No.2 of 2016 before the Senior Civil Judge, Tadepalligudem. Pending the said appeal, he filed I.A.No.221 of 2016 for temporary mandatory injunction. That application was rejected on 23-06-2016. This order is questioned in the Revision Petition. 4.
Having regard to the facts and circumstances of the case, I deem it appropriate to dispose of the Civil Revision Petition directing the Senior Civil Judge, Tadepalligudem to decide C.M.A.No.2 of 2016 itself within two months from the date of receipt of a copy of this order since the said appeal itself was filed in February 2016. No costs. 5.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
