THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 46847 OF 2016 O R D E R:

This Writ Petition is filed for quashing F.I.R.No. 290 of 2016 dated 21-12-2016 registered by respondent No. 2 on the complaint made by respondent No. 3. The complaint was registered as F.I.R.No. 290 of 2016 under Sections 341 and 509 of the Indian Penal Code read with Section 4 (1) (s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015 (for short, 'the Act').

This Court carefully perused the complaint alleged to have been lodged by respondent No. 3 and it shows that there was an allegation against the petitioners with regard to naming of the complainant with her caste. The matter requires investigation and this Court cannot interfere with the investigation process. However, it is directed that respondent No. 2 shall not arrest the petitioners pursuant to the registration of the crime under the provisions of the Act without obtaining necessary orders from the concerned Magistrate. The Writ Petition is accordingly disposed of. Pending miscellaneous petitions, if any, in this Writ Petition shall stand closed in consequence. No order as to costs.
