B. Tejeswara Rao v. The A.P. Administrative Tribunal
THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND THE HON'BLE SRI JUSTICE G.SHYAM PRASAD W.P.No. 19210 OF 2016 DATED 16TH JUNE, 2016 Between:
B.Tejeswara Rao and others ... Petitioners AND The Andhra Pradesh Administrative Tribunal, Purani Haveli, Hyderabad, Rep. by its Registrar, and others ... Respondents Counsel for the petitioners : Sri K.Satyanarayana Murthy Counsel for the respondents : G.P. for Higher Education (A.P.)
THIS COURT MADE THE FOLLOWING ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed by the applicants in O.A.No. 1783 of 2016 before the Andhra Pradesh Administrative Tribunal at Hyderabad (for short, 'the Tribunal') not being satisfied with the order of the Tribunal, staying recovery of excess amounts from the petitioners.
2. A perusal of the impugned order shows that the said interim order was passed while admitting the O.A. and issuing notices to the respondents, returnable within four weeks, by the Tribunal.
3. In our opinion, if the petitioners seek further interim relief, not granted by the Tribunal so far, they can request it to consider their further request and pass appropriate order. Hence, we are not inclined to entertain this Writ Petition for the purpose of considering grant of further reliefs which have not so far been denied by the Tribunal.
4. Subject to the above observation, the Writ Petition is dismissed.
5. As a sequel to dismissal of the Writ Petition, W.P.M.P.No. 23557 of 2016 stands dismissed as infructuous.
