HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.2650 of 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.

The petitioner's grievance in the present writ petition is that the respondents are trying to dig the petitioner's land admeasuring Ac.4-00 cents in Sy.Nos.130/2 and 130/3 situated at Kambhampadu Village, Pedakurapadu Mandal, Guntur District, without following due process of law and without paying compensation to him.

Learned Government Pleader has received instructions, which state that one Sri A.V.Koteswararao and another made a representation before the 3rd respondent requesting to conduct survey in Sy.No.130/2 under Neeru-Chettu Programme as Sy.No.130 is classified as Tank Poramboke. Accordingly, the Mandal Surveyor and the Village Revenue Officer, Kambhampadu are stated to have visited the land for verification of boundaries. It is, however, categorically stated that no action was initiated for dispossession of the petitioner from his land. Learned Government Pleader states that only for the purpose of survey and verification of boundaries the Mandal Surveyor and the Village Revenue Officer, Kambhampadu are stated to have visited the land and if any action is intended to be taken against the petitioner's land, the respondents would follow due process of law. Recording the said assurance, therefore, the writ petition is disposed of. No costs.
