HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.20634 of 2015 ORDER:

Heard.

The petitioner, who claims to be in possession of Ac.1-10 cents in Sy.No.651 of Padamatipalem Village, Sangam Mandal, SPSR Nellore District, has filed representations, dated 06-07-2010 and 20-01-2015 before the 4th respondent requesting to assign the said land to her. She states that the Village Revenue Officer conducted enquiry, but no final decision is taken. The present writ petition is filed alleging inaction of the respondents and the petitioner states that she is eligible for assignment as per the Board Standings Orders 15 para 10.

Learned Government Pleader, who has received instructions, states that the Village Revenue Officer inspected the land and submitted his report. The report shows that the petitioner purchased the land from S.C. Community people under an unregistered sale deed in the year 2012. Though the instructions speak of ineligibility of the petitioner for assignment, no orders are passed on the representations of the petitioner, referred to above. Whether the petitioner is entitled for assignment and whether her case is covered under the Board Standing Orders, as referred to above, are matters which requires consideration by the 4th respondent. Hence, the writ petition is disposed of directing the 4th respondent to examine the aforesaid representations of the petitioner and after notice to the petitioner, take appropriate decision in accordance with law, expeditiously and communicate the same to the petitioner. There shall be no order as to costs.

Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 21-07-2015 Prv
