THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.31801 of 2015 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India challenging the order of the 2nd respondent dt.24-07-2015 suspending the authorization of petitioner pending enquiry.

2. On the same day, a show cause notice was also issued to petitioner. The petitioner submitted his explanation to the same on 04-08-2015 denying the allegations against him. Even though three months have elapsed since the date of submission of explanation, the 2nd respondent has not conducted any enquiry in the matter.

3. Since petitioner's authorization cannot be kept under suspension indefinitely by not conducting any enquiry, the Writ Petition is disposed of directing the 2nd respondent to complete the enquiry into the allegations against petitioner within four (04) weeks from the date of receipt of a copy of this order positively. The suspension of petitioner's authorization as Fair Price Shop dealer would be subject to the result of the enquiry. No costs.

4. As a sequel, miscellaneous petitions pending if any, shall stand closed.
