THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.4882 of 2016 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The instructions of learned Government Pleader for Revenue show that the petitioner - Society, which consists of about 280 families encroached Acs.5.45 cents of land in Survey No.83-1B3E1 of Upparapalli Village, which is earmarked for assignment to various Governmental authorities. The land in question is also proposed to be transferred in favour of Deputy Secretary, APR School for Minorities Boys, Anantapuram, for construction of school buildings, Dormitories and Residential quarters. It is stated that if the members of the petitioner - Society are from the economically weaker sections, the Government has two schemes, namely, House For All and NTR Gruha Kalpa Scheme and it is open for the petitioner - Society to enrol in the aforesaid scheme and seek the benefits. However, none of the members of the petitioner - Society have applied so far under any of the schemes.
The petitioner - Society claims to be in possession and apparently traced to the encroachment referred to in the instructions. Hence, the 3rd respondent is directed to take appropriate action as per law and the members of the petitioner -Society also granted liberty to apply under any of the beneficiary schemes of the State and seek appropriate relief.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
