Learned counsel appearing for the appellant seeks permission of this Court to withdraw the Appeal Suit stating that the subject matter of the Appeal Suit was settled out of Court and to that effect, he has filed a letter dated 02.01.2019 in the Registry. Permission as sought for is accorded.

Accordingly, the Appeal Suit is dismissed as withdrawn. Miscellaneous petitions, if any, pending shall stand closed. No costs.
