Learned counsel for the petitioner does not press this C.R.P and seeks liberty to the petitioner to file fresh application for appointment of Court Commissioner, if the circumstances so demand. C.R.P is disposed of as not pressed. It is open to the petitioner to file application as aforementioned, if law so permits and if the circumstances so demand. If any such application is made, I hope and trust that the Court below shall consider the same strictly in accordance with law. I observe that learned counsel for the petitioner sought the liberty, as aforementioned, in view of the fact that the application for appointment of Court Commissioner was made even before leading evidence.
