HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.38964 OF 2016 ORDER:

This writ petition is filed declaring the action of the respondents in trying to take possession of the petitioner's land admeasuring Ac.0.25 cents in R.S.No.24/7B-1 and Ac.0.25 cents in S.No.24/7A-1 situated in Kesarapalli Village, Gannavaram Mandal, Krishna District, as illegal and arbitrary.

Counter affidavit is filed the 5th respondent stating that the survey numbers mentioned in the document are different from that of the land claimed by the petitioner. Further it is stated that the land in R.S.No.24-7B was resumed by the then Tahsildar long back in the year 2007, as such the question of evicting the petitioner from the subject land does not arise.

No reply affidavit is filed disputing the averments in the counter affidavit.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. The petitioner has not shown any document to show that he is in possession of the subject land. In view of the stand taken in the counter affidavit and facts and circumstances, I do not see any reason to

entertain the writ petition. Accordingly, the writ petition is dismissed. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 09.02.2017 dv
