SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.1 1 3 1 0 of 2 0 1 8 ORDER:

This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioner, who is the accused, in Cr.No.557 of 2018 on the file of the Station House Officer, Hayathngar Police Station, Rachakonda District.

The offences alleged are under Sections 420, 468 and 471 of the Indian Penal Code.

2.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.

3.

The allegations against the petitioner are that on 30.06.2008, the plot of the complainant was illegally registered in the name of somebody else by impersonation and subsequently, the petitioner sold the property to others. The same came to light when the complainant took EC, which showed that it was sold away by the petitioner. 4.

Hence, considering the nature of the allegations, this Court does not find it a fit case to grant anticipatory bail to the petitioner. Hence, the criminal petition is dismissed. However, considering the request of the petitioner, the Court below is directed to dispose of the bail petition that would be filed by the petitioner, preferably, on the same day subject to pressure of other work. As a sequel, the miscellaneous applications, if any pending, shall stand closed. __________ T. RAJANI, J November 2, 2018 DSK
