THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.920 OF 2016 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C. by the petitioner/accused challenging the order, dated 4.12.2015, in Crl.M.P.No.1608 of 2015 in C.C.No.254 of 2014 on the file of the Judicial Magistrate of First Class for Railways, Guntur wherein the petition filed by the petitioner under Section 251 Cr.P.C. praying the Court below to discharge him from the alleged charge under Section 138 of the Negotiable Instruments Act, 1881, was dismissed.

2. Heard and perused the material available on record.

3. After arguing for sometime, learned counsel for the petitioner, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner before the trial Court.

4. Considering the facts and circumstances of the case, the presence of the petitioner before the trial Court is dispensed with except on the dates on which the learned Magistrate insists for his appearance. The petitioner shall be properly represented through his counsel before the trial Court.

5. Accordingly, this Criminal Revision Case is disposed of. Miscellaneous petitions pending, if any, in this Criminal Revision Case shall stand closed.
