THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.38633 of 2018 ORDER:

The grievance of the petitioner in the present writ petition is inaction on the part of the 4th respondent in finalizing the tender notification dated 17-07-2018 pertaining to supply of diet to the District Hospital, Khammam.

The respondents herein issued notification dated 17-07-2018 calling for tenders for catering of diet food to the in-patients for a period of one year in Government District Head Quarters Hospital, Khammam. In response to the same, the petitioner herein submitted his tender along with certain other diet contractors. It is further stated that screening committee consisting of District Revenue Officer and Administrative Director of DCHS i.e. 1st and 2nd respondents scrutinized the tender applications as per G.O.Ms.No.325, dated 01-11-2011 and declared that the petitioner and other two applicants were qualified in technical bid. Thereafter, for finalizing the bid, the 3rd respondent requested the petitioner and other applicants to submit an undertaking NOC.

According to the petitioner, he submitted a representation on 30-10-2018 to the respondents herein for finalizing the tenders. The grievance of the petitioner is that despite lapse of considerable length of time, the tenders have not been finalized by the respondents. Having heard the learned counsel for the petitioner and the learned Government Pleader for Medical & Health, this Court deems it appropriate to dispose of the writ petition with a direction to the 4th respondent to verify the representation submitted by the petitioner on 30.10.

with law within a period of four (04) weeks from the date of receipt of copy of this order, if no orders are passed so far. Writ petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
