HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.19806 of 2015 ORDER : (per Hon'ble Sri Justice R.Subhash Reddy) In C.C.No.385 of 2014 filed by the 2nd respondent against the petitioner herein, the District Consumer Forum-II, Hyderabad, has granted temporary exparte injunction order dated 12.06.2014 and by further order dated 16.07.2014, the said exparte injunction order was made absolute, on condition of the 2nd respondent herein paying Rs.1,500/- per month towards maintenance charges till disposal of the main case.

As against the order dated 16.07.2014, the 2nd respondent/complainant carried the matter by way of revision in R.P.No.55 of 2014 before the A.P. State Consumer Disputes Redressal Commission, Hyderabad, and obtained interim order dated 25.08.2014 in R.P.I.A.No.1590 of 2014 in R.P.No.55 of 2014. Aggrieved by the said order, the petitioner herein filed vacate petition. As the State Commission is not functioning for want of Quorum, the petitioner has approached this Court by way of filing the present writ petition.
3. During the pendency of the writ petition, in view of appointment of the President, the State Commission has started functioning. If the vacate application of the petitioner is pending consideration before the State Commission, the petitioner as well can pursue such application for vacation of the interim order.
4. For the aforesaid reasons, we do not find any merit in this writ
petition warranting interference by this Court, at this stage.
5. Accordingly, this writ petition is disposed of granting liberty to the petitioner to pursue the vacate application filed before the A.P. State Consumer Disputes Redressal Commission, Hyderabad. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
