HON'BLE SRI JUSTICE Dr. B. SIVA SANKARA RAO MACMA.Nos.3022, 3004, 2996 & 2987 of 2017 COMMON JUDGMENT:

These appeals are maintained against the respective awards of the Motor Accidents Claims Tribunal-cum-IX Additional District & Sessions Judge (FTC), Visakhapatnam, dated 09.12.2014 in respective O.P.Nos.588, 662, 548 & 581 of 2012. Along with these appeals, there are separate applications besides seeking stay before admission, application to condone the representation delay of 96 days apart from application to condone the filing delay of 857 days or 856 as the case may be. The above appeals commonly came for consideration as to any just grounds to condone the representation delay and the filing delay by ordering notice and keeping the matters pending. In fact the amounts awarded in the respective claims are Rs.15,000/- in O.P.No.588 of 2012, Rs.15,000/- in O.P.No.662 of 2012, Rs.22,000/- in O.P.No.548 of 2012 and Rs.32,000/- in O.P.No.

581 of 2012. Even the statutory amount of 50%, the insurer claimed deposited. In view of the small amounts involved, but for to say the disposal of these matters will not prejudice any of the legally available contentions of the insurer vis-à-vis of the other party of another MACMA.No.3012 of with representation delay condonation and filing delay condonation respectively on own merits.

Having regard to the above, these four appeals are disposed of for nothing to condone the delay in filing or delay in representation in view of the very small amounts. It is made clear

Dr. SSRB,J that the insurer has to deposit the balance amount within eight

(08) weeks from today.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
