This Criminal Petition ls filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking to quash the proceedings against the petitioner/accused No.39 in C.C.No.1479 of 2O22, on the file of the learned Special Judicial Magistrate of First Class for Trial of cases under Telangana Prohibition and Excise Act-cum-lV Additional Junior Civil Judge, Karimnagar, registered for the offences punishable under Sections 471, 468 and 420 read with Section 34 of lPC.

2. Heard Sri P.Pankaj Reddy, learned counsel for the petitioner as well as Sri Jitender Rao Veeramalla, the learned Additional Public Prosecutor appearing for the respondent-State 3.
When the matter is taken up for hearing, learned counsel for the petitioner has limited his prayer seeking a direction to dispense with the appearance of the petitioner before the Trial Court 4.
The learned Additional Public Prosecutor submitted that appropriate orders may be passed 5.
Perused the record. C.C.No.1479 of 2022 is pending on the file of the learned Special Judicial Magistrate of First Class for Trial of cases under Telangana Prohibition and Excise Act-cum-lV Additional Junior Civil Judge, Karimnagar. Considering the submissions made by both parties and in view of the facts and circumstances of the case, it is deemed appropriate to dispose of the Criminal Petition by dispensing with the appearance of the petitioner before the Trial Court.

Hence, the Criminal Petition is disposed of dispensing with the presence of the petitioner/accused No.39 before the Trial pourt provided that the petitioner is represented through an \ \ !
