THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5089 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in crime No.20 of 2016 on the file of the B.N.Kandriga Police Station, Tirupati, registered for the offences under Sections 307, 353, 379, 120-B IPC and Section 20(i)(ii)(iii)(iv)(v) and (x) and 29(ii)(b) of the A.P.Forest Act and contravention of Rule 3 of the Red Sandal Wood Possession Rules, 1989.

Heard and perused the material available on record. On perusal of the entire material available on record, prima facie there are allegations against the petitioners, which are to be investigated into by the police. Hence, this Court is not inclined to quash the impugned proceedings at this stage. The petitioners are given liberty to file criminal petition if they are aggrieved over the charge sheet after filing of the same.
