- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.2812 OF 2018 ORDER :

This contempt case is filed alleging non-compliance of the order dated 07.11.2017 made in W.P.No.8234 of 2010 by the respondent. By order dated 07.11.2017, the writ petition was disposed of. Overruling the objections, the respondent-TSIIC rejected the request of petitioner for regularization of services in accordance with G.O.Ms.No.212 dated 22.04.1994, on the ground that petitioner was physically not working on 25.11.1993. Having regard to the fact that petitioner was successful in I.D.No.35 of 1993 and duly taking note of the fact that junior to him was already regularized directions were issued by this Court. Alleging non-compliance of the order of this Court, this contempt case is filed.

Learned counsel for the petitioner produced proceedings dated 27.11.2018, where under the services of petitioner was regularized. However, learned counsel for the petitioner sought to contend that regularization is granted only from 27.06.2018, whereas, his junior was regularized long ago. Therefore, he is entitled to regularization from retrospective date. 3.

The said claim may be valid, but it does not come within the purview of contempt when there is no such direction issued by this Court.

Thus, leaving it open to the petitioner to work out his remedies, with reference to his grievance as briefly noted above,

- 3 - this Contempt case is closed. Pending miscellaneous petitions shall stand closed.
