THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10208 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

It is the case of the petitioner that he was appointed as a fair price shop dealer in respect of B.T. Project F.P. Shop No.7 on 19.06.2004. Further, on 18.03.2016 when he approached the 5th respondent along with a demand draft for issuance of commodities for the month of April, 2016, he was denied of the same. It is further submitted that the petitioner paid the amount for renewal of authorization on 11.03.2016.

According to the petitioner, he submitted a representation to the 5th respondent on 19.03.2016 along with challan and the same is still pending consideration. Now, it is the grievance of the petitioner that he has not been released the stocks for the month of April, 2016, on the ground that there is no valid authorization subsisting. Hence, this writ petition. Admittedly, petitioner is a fair price shop dealer and his application for authorization is pending consideration before the respondents. Till the date, no order of suspension or cancellation is passed by the respondents.

Renewal of suspension being a formality, the respondents cannot abruptly stop supply of stocks of essential commodities to his fair price shop that too when his application for renewel is pending consideration. In that view of the matter, the respondents are directed to consider the application of the petitioner for renewal of authorization, take a decision and communicate the same to the petitioner. Pending consideration of petitioner's application for renewal, respondents are directed to continue him as the fair price shop dealer

and permit him to distribute the essential commodities. Subject to above directions, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions pending in the writ petition, if any, shall stand closed.
