This writ petition is filed against the order dated 04-11-2016 in Rc.DICS/2351/2016, whereby the 2nd respondent issued show-cause notice-cumsuspension orders suspending the authorization of the petitioner fair-price shop.
Learned counsel for the petitioner submits that though variations are within permissible limits, the impugned order of suspension is passed. He also submits that though the petitioner filed explanation to the show-cause notice, no orders are passed. He also submits that for minor variations, suspension pending enquiry is unwarranted.
Learned Assistant Government Pleader for Civil Supplies submits that there are major variations. As such, suspension pending enquiry is ordered and no interference is warranted.
A perusal of the impugned proceedings goes to show that prima facie variations are not on higher side. In view of the same, as the petitioner has already submitted explanation, it is for the 2nd respondent to pass final orders after giving opportunity to the petitioner. The said
exercise shall be done within a period of eight weeks from the date of receipt of a copy of this order. Till such time, operation of the impugned order is suspended. With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
