This petition is filed challenging the action of the 2nd respondent in not disposing of petitioner's representation dated 27.08.2018 and application through Mee-Seva vide APDLO 11800154299, dated 08.10.2018, for deletion of survey number with regard to the petitioner's land to an extent of Ac.3.60 cents in Sy.No.1012 of Thatiguntapalli Village, Vayalpadu Mandal, Chittoor District, and for updation in re-settlement Register as per the A.P.Dotted Lands (Updation in Re-settlement Register) Act, 10 of 2017 (for short 'the Act').
Learned counsel for the petitioner submits that the petitioner made an application on 27.08.2018 under Section 7 of the Act for deletion of the subject property from the list of prohibited properties under Section 22A of the Registration Act, is not being disposed of.
On the other hand learned Assistant Government Pleader for Revenue submits that as per Section 7 of the Act, an order has to be passed before six months from the date of filing of the claim and that the authorities are still having time for passing orders.
Just because six months time is provided in the Act does not mean that the authorities have to wait for six months for passing orders. It is outer limit for passing orders. In view of the facts and circumstances, since application is already pending before the 2nd respondent, the 2nd respondent is directed to dispose of the application of the petitioner in terms of Section 7 of the Act, as expeditiously as possible.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 26.10.2018 t k.
