THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27007 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner is a licensed dealer in grams and groundnut and the license of the petitioner is valid up to 31.02.2016. While so, the third respondent inspected the business premises of the petitioner on 12.08.2015 and seized 70.120 MTs groundnut with shell. A case under Section 6-A of the Essential Commodities Act was registered and is pending before the second respondent. When no orders were passed on the petition filed by the petitioner on 17.08.2015 for releasing of the said stock, the present writ petition is filed.

3. Since the petitioner filed a petition for releasing of the seized stock, the continuation of detention of the seized stock is not benefit to the Government as well as to the petitioner.

4. In the circumstances, this writ petition is disposed of directing the second respondent to release the seized stock, as and when the petitioner furnishes bank guarantee for the value of the seized stock i.e., Rs.31,55,400/-. In the meanwhile, the respondents shall not sell the seized stock. No order as to costs.
