HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.1504 of 2015 ORDER:

Heard.

Alleging inaction on the part of the 1st respondent in registering crime based on the complaint of the petitioner, dated 05-01-2015, the present writ petition is filed.

Learned Government Pleader has received instructions, which state that the complaint, dated 04-01-2015 filed by the petitioner was received by the 1st respondent and the same was entered in the general diary and took up preliminary enquiry.

The present writ petition however refers to non-registration of crime on the complaint of the petitioner, dated 05-01-2015. The instructions state that no such complaint, dated 05-01-2015 was received by the 1st respondent. In view of the said controversy, learned counsel for the petitioner states that the petitioner has filed only complaint, dated 04-01-2015 and the petitioner would be satisfied if the said complaint is looked into and appropriate steps are taken in that regard.

Since the aforesaid complaint is already entered by the 1st respondent in the general diary and preliminary enquiry is taken up, the writ petition is disposed of directing the 1st respondent to examine the petitioner's aforesaid complaint and after preliminary enquiry, take appropriate decision in accordance with law. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
