HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.616 of 2016 ORDER:

The present Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C. challenging the order dated 25.01.2016 passed in Crl.M.P.No.392 of 2014 in M.C.No.138 of 2014 on the file of the Judge, Family Court at L.B.Nagar, Ranga Reddy District, wherein and whereunder the trial Court granted interim maintenance of Rs.5,000/- per month to the second respondent herein.

A perusal of the material on record would show that the second respondent herein, who is the wife of the petitioner, filed an application under Section 125 (1) Cr.P.C. claiming monthly maintenance of Rs.50,000/-. By an order dated 25.01.2016, the learned trial Judge awarded interim maintenance at Rs.5,000/- per month to the second respondent herein. Challenging the same the present revision is filed.

Learned counsel for the petitioner submits that the second respondent is a M.B.A. graduate earning Rs.30,000/- per month as such she is not entitled for any maintenance. A perusal of the order under challenge would show that the trial Court after considering the material placed before it awarded interim maintenance of Rs.5,000/- per month to the second respondent herein. The pay slips of the petitioner filed before the Court would show that the petitioner was earning Rs.46,356/- per month. Having regard to the net income earned by the petitioner awarding Rs.5,000/- per month warrants no interference. Since

the main M.C. is still pending, the trial Court is directed to dispose of M.C.No.138 of 2014 as expeditiously as possible, preferably, within a period of four (04) months from the date of receipt of a copy of the order.

With the above direction, the Criminal Revision Case is disposed of.

Miscellaneous petitions, if any, pending, shall stands closed.
