This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioner, who is A5, in Cr.No.305 of 2018 on the file of the Station House Officer, Badvel (U) Police Station, Badvel, Y.S.R. District. The offences alleged are under Sections 408, 409 and 420 read with Section 34 of the Indian Penal Code.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.

The allegations against the petitioner are that he is an outsourcing bill collector in Badvel Municipality and that the amounts, which were paid by the paid by the tax payers, were misappropriated. The amount shown against the name of the petitioner is Rs.5,81,930/ - 4.

The counsel for the petitioner submits that after verification, the petitioner paid the entire amount and that this crime pertains to the offence which occurred in the year 2016.

Learned Public Prosecutor, on the other hand, submits that the auditors were also shown as accused and that the investigation is still going on and that the custodial interrogation of the petitioner is very much required. He further submits that the petitioner, though was found to have collected huge amounts, did not remit the same to the municipality.

Hence, considering the nature of the allegations, this Court does not find it a fit case to grant anticipatory bail to the petitioner. Hence, the criminal petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed. __________ T. RAJANI, J November 2, 2018 DSK
