THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.445 OF 2016 ORDER:

This Contempt Case was instituted alleging willful disobedience to the order dated 24.11.2015 passed in W.P.No.38076 of 2015. By the said order, this Court directed the police authorities to abide by the mandate of the Supreme Court in Lalita Kumari vs. Government of Uttar Pradesh1 in relation to the writ petitioner's complaint dated 23.9.2015. The Sub-Inspector of Police, Kodimial police station, the respondent, filed a counter affidavit stating that he never received any complaint from the petitioner and that the petitioner never approached him as alleged by him. Though this counter affidavit was filed as long back as on 19.8.2016, no reply affidavit was filed by the petitioner, rebutting the averments made therein. In that view of the matter, this Court finds no reason to infer any disobedience, much less willful disobedience, warranting exercise of contempt jurisdiction.

The Contempt Case is accordingly dismissed. No order as to costs. ----------------------- SANJAY KUMAR, J.
