HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.38883 OF 2018 ORDER :

This writ petition is filed challenging the action of the 5th respondent in insisting the petitioners to get 'No Objection Certificate' (NOC) from the respondents 2 to 4 to the land bearing Sy.Nos.254/2, to an extent of Ac.0.50 cents, Survey No.254/5 to an extent of Ac.1.00 cents out of Ac.2.14 cents, Sy.No.284/16 to an extent of Ac.0.47 cents out of Ac.0.76 cents and Sy.No.274/8 to an extent of Ac.0.47 cents, total an extent of Ac.2.44 cents, situated at Vellanki Revenue Village, H/o.Boddpalem, Anandapuram Mandal, Visakhapatnam district and in not informing the stamp duty and registration charges payable to registrar the said land in favour of the third parties.

Learned Counsel for the petitioner submits that this Court in similar circumstances, disposed of WP.No.2760 of 2017, dated 27.01.2017 and the same is not disputed by learned Assistant Government Pleader for Revenue. In view of the same, and for the reasons alike, the writ petition is disposed of and it is open for the petitioners to present the document before respondent No.5 for registration and on such submission, the 5th respondent is directed to receive and process the document presented by the petitioners for registration in relation to the subject property,

if the same is in order and is not in the list of prohibited properties as per Section 22 A of the Registration Act and there is no injunction operating against the properties regarding alienation of the properties. If he wants to refuse registration, he shall pass appropriate orders duly recording the reasons for such refusal in accordance with Section 71 of the Act and communicate the same to the petitioners. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 30.10.2018 t k.
