Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents. This Writ Petition is filed seeking to declare the action of the respondents in not considering the case of the petitioner for appointment as Fair Price Shop Dealer on compassionate grounds in terms of G.O.Ms.No.4, dated 28.02.2014, as arbitrary and illegal.

The husband of the petitioner was the permanent Dealer of Fair Price Shop No.2, R.C. Puram Mandal, Chittoor District, and after his death, the respondents continued the petitioner as Fair Price Shop Dealer on temporary basis. Learned counsel appearing for the petitioner submits that by virtue of G.O.Ms.No.4, dated 28.2.2014, the dependants of the deceased Fair Price Shop Dealers, have to be considered for appointment as Fair Price Shop dealers, on compassionate grounds, subject to fulfillment of the conditions stipulated in G.O.Ms.No.4. Learned counsel further submits that based on the application submitted by the petitioner, the 3rd respondent addressed a letter to the 4th respondent to take necessary action and submit proposals for appointment as Fair Price Shop Dealer on compassionate grounds, but so far no action has been taken.
